Developing value-sharing frameworks

Value sharing mechanisms will need to evolve in the era of the energy transition, to go beyond what has been applied in the past on mining, oil & gas, agricultural and other projects impacting traditional lands.


Modern structures will need to cater for sustainable sharing of value over the lifecycle of a project, calibrated to balance the realities of project economics (particular in nascent technologies such as hydrogen) with the impacts on traditional lands from project commencement.


We draw on evolving precedents globally, particularly in Canada, where benefits sharing has become prevalent in recent energy infrastructure developments, as well as recent examples that have emerged in Australia. Each situation will be unique, and all parties need to take the time to consider the most appropriate framework for each project.

Project structuring including direct Traditional Owner project participation

Project structures are evolving to include direct Indigenous partnership, including equity ownership. Each project will need detailed assessment as to which structure is most appropriate given the relevant project risks and objectives.


We will work closely with key stakeholders to define and evaluate alternative pathways, select a preferred approach and support its implementation.

Financial and commercial advisory

Transition Advisory can support Traditional Owners in evaluating potential pathways on projects being proposed by government or private developers.

  • Reviewing financial and commercial terms being proposed by developers
  • Supporting the co-development of value sharing frameworks, including profit or revenue-linked mechanisms that provide long term income streams

  • Negotiation support, including preparing for negotiations and supporting Traditional Owners during negotiations with 3rd parties.
